Draft Revision of Anti-Unfair Competition Law Invites Public Comments

On 25 December 2024, the Draft Revision of Anti-Unfair Competition Law of the People's Republic of China, after being reviewed at the 13th session of the Standing Committee of the 14th National People's Congress (NPC), was published on the website of NPC for public consultation.

These latest amendments to the Chinese Anti-Unfair Competition Law, preceded by revisions in 2017 and 2019 since its first promulgation in 1993, were made with a view to addressing issues emerging in recent years attending rapid economic development. The draft revision, among others, clarifies obligations of business operators and responsibilities of relevant departments, strengthens supervision on unfair competition in cyberspace and commercial bribery, and refines the provisions on false advertising, deceitful prize-giving sales, commercial defamation, and abuse of dominant position. The draft revision also increases the penalties for unfair competition.

Interested parties may give their opinions, by the deadline of 23 January 2025, via the website of NPC (www.npc.gov.cn) or by writing directly to the Legislative Affairs Commission of the NPC Standing Committee.
