International Trademark Association Updates Model Trademark Law Guidelines
On 12 November 2024, a resolution approving the comprehensive updates to the Model Trademark Law Guidelines was adopted by the board of directors of the International Trademark Association (INTA). The updates incorporate significant changes in global trademark laws as well as INTA's policy positions.
Key updates of the revised Guidelines include enhanced provisions for partial cancellation of trademark registrations, clarified protection standards for well-known marks as provided for under the TRIPS Agreement, and more flexible language for the depiction of marks using generally accepted technologies. The Guidelines also endorse strengthening the recognition of letters of consent and coexistence agreements in trademark examination process.
The updated Guidelines will continue to serve as INTA’s primary reference for government policy officials and lawmakers on trademark law development.
INTA, headquartered in the New York City, was founded in 1878. It is a not-for-profit association of brand owners and professionals dedicated to protect and promote the rights of trademark owners, secure useful legislation, and give aid and encouragement to the advancement and observance of trademark rights, with membership comprising more than 6,700 organisations from 185 jurisdictions, representing nearly 37,500 individuals (trademark owners, professionals and academics).
