CNIPA Invites Comments on Draft Provisions for Regulating Trademark Application Behaviours
The China National Intellectual Property Administration (CNIPA) has recently released Several Provisions for Regulating Behaviours Related to Application for Registration of Trademark (Consultation Draft), which is now open for public comments until 14 March 2019.
The draft provisions, consist of 8 articles, explicitly state that the applicant for trademark registration or its trademark agent shall not engage in irregular trademark application behaviours, and further specify the types of irregular behaviours, along with consequences of those behaviours according to the Trademark Law or Implementing Regulations of the Trademark Law as well as discretionary measures that the behaviours may be subject to.
