China's NDRC Publishes Draft Anti-Monopoly Guidelines Against IPR Abuse for Public Comments
The Bureau of Price Supervision and Anti-Monopoly under the National Development and Reform Commission (NDRC) of China has recently published the Anti-Monopoly Guidelines Against the Abuse of Intellectual Property Rights (Draft for Comments) ("the Guidelines") to seek public opinions.
The Guidelines adhere to the legislative spirit of the Anti-Monopoly Law of China, and aim at providing a clear and reasonable expectation for the market and improving the transparency of anti-monopoly enforcement by formulating specific anti-monopoly guiding rules against the abuse of IP. The Guidelines are expected to be finalised by the first half of this year.
Interested parties may communicate their views on the Guidelines through the official webpage of the Bureau of Price Supervision and Anti-Monopoly of NDRC during the period of 1-20 January 2016.
