The 3rd Innovation China & IP Forum cum Patent Law Revision & Patent Implementation Symposium Held in Beijing

The 3rd Innovation China & IP Forum cum Patent Law Revision & Patent Implementation Symposium was held in the Law School of Renmin University of China (RUC), Beijing on 18 July 2015. The symposium was jointly organised by China Intellectual Property Law Association, Law School of RUC, Intellectual Property Academy of RUC, Research Center of Civil and Commercial Jurisprudence of RUC, and Theoretical Research Bases for Judicial Protection of Intellectual Property Rights of Supreme People's Court of China.

The event gathered more than a hundred experts and academics from IP, legal, and industry sectors to discuss heated issues relating in particular to the fourth revision of the Chinese Patent Law and patent implementation in China. Topics explored during the symposium included legal protection for industrial designs, patent affirmation and implementation procedures, exercise of patent right, remedies for patent infringement, and latest development in judicial adjudication of patent disputes in China.

According to the draft amendment of the Patent Law recently published by the State Intellectual Property Office of China (SIPO) for public comments, this revision of the Chinese Patent Law involves substantive changes to 30 articles, including the addition of a new chapter on patent implementation and exploitation. The revision intends to address a number of major theoretical as well as practical issues, such as the relationship between administrative enforcement and judicial protection of IP right, and the roles of Patent Reexamination Board.
