China’s State Administration for Industry and Commerce Announces New Batches of Well-known Marks
On 27 April 2012, China's State Administration for Industry and Commerce (SAIC) announced that a total of 599 well-known trademarks were recognised during the period between 30 November 2011 and 27 April 2012 by its Trademark Office or Trademark Review and Adjudication Board (TRAB), in comparison with 478 well-known marks recognised during the previous period of 28 May 2011 to 29 November 2011.
The new batches of well-known marks include:
(i) 39 marks established by Trademark Office in trademark opposition cases;
(ii) 410 marks established by Trademark Office in trademark administration cases; and
(iii) 150 marks established by TRAB in cases relating to reexamination of trademark opposition or trademark disputes.
In China, the well-known status of a trademark can be sought through judicial process by the courts during litigation, or through administrative process by SAIC’s Trademark Office or Trademark Review and Adjudication Board.
