Beijing Higher People’s Court Holds Forum to Discuss Revision of Opinions on Patent Infringement Establishment
On 11-12 August 2011, a forum to discuss the Opinions of Beijing Higher People’s Court on Several Issues Relating to Patent Infringement Establishment (draft for comment) was held by Beijing Higher People's Court in collaboration with Quality Brands Protection Committee of China Associations of Enterprises with Foreign Investment (CAEFI) in Beijing.
The forum was attended by about 70 participants from judicial and legal sectors comprising senior judges, patent examiners and patent attorneys. During the session, the participants discussed and made suggestions on each of the 140 articles of the Opinions, with a view to hammer out the draft for comment within the year.
Over the years, judicial opinions of the same title promulgated by Beijing Higher People’s Court in 2001 have been relied upon by local courts nationwide in trying patent infringement cases. However, revision of said 2001 opinions has become necessary with the development of the patent trial practice, especially after the promulgation and implementation of the new Patent Law (2008) and the Supreme People’s Court’s Interpretation of Several Issues Concerning Application of Law to Trial of Cases of Disputes Arising from Infringement of Patent Rights (2009).
