CNIPA Invites Comments on Draft Revision of Chinese Trademark Law
The China National Intellectual Property Administration (CNIPA) has recently published the Draft Revision of the Trademark Law of the People's Republic of China (Draft for Comments) for public consultation.
This Draft for Comments brings the following amendments, among others, to the current Chinese Trademark Law: adjustment to the concept and scope of trademarks and extension of the scope of elements eligible for trademark registration; adjustment to the trademark opposition procedure; introduction of reverse compensation for bad-faith litigation; added provisions against repeat registrations; enhanced protection for well-known trademarks; increase of trademark types subject to cancellation; and clarifying the boundary for the exercise of exclusive rights to use trademark.
Members of the public may reflect their views on the Draft for Comments by the deadline of the consultation on 27 February 2023 to the Department of Treaty and Law of the CNIPA via email (tiaofasi@cnipa.gov.cn), fax or by mail.
