CNIPA Seeks Public Opinions on Draft Determination Standards for General Trademark Violations
On 17 August 2021, the China National Intellectual Property Administration (CNIPA) published the Determination Standards for General Trademark Violations (Draft for Comment) for public consultation. The draft Standards, with a view to enhancing trademark administration and unifying enforcement standards, stipulate the definition, specific circumstances, and legal consequences of various types of general trademark violations, including failure to use a registered trademark where it is required to, the use of a mark that may not be used as trademark, and the use of the words "well-known trademark" on products or in commercial activities.
Comments on the draft Standards may be submitted to Department of Intellectual Property Protection of the CNIPA via post, email or fax before the deadline of 1 October 2021.
