SPC Invites Public Comments on Three Draft Judicial Interpretations Relating to Trade Secret Infringement, Internet IP Infringement & E-Commerce Platform IP Disputes
The Supreme People's Court of China (SPC) has published on 10 June 2020 the following three draft IP-related judicial interpretations for comments from the public:
i) Interpretation of the SPC on Several Issues Concerning the Application of Law in the Trial of Civil Cases Involving Disputes over Trade Secret Infringement (Draft for Comment) [最高人民法院关于审理侵犯商业秘密纠纷民事案件应用法律若干问题的解释(征求意见稿)];
ii) Reply of the SPC on Application of Law in Disputes over Internet Intellectual Property Infringement (Draft for Comment) [最高人民法院关于涉网络知识产权侵权纠纷有关法律适用问题的批复(征求意见稿)];
iii) Guiding Opinions of the SPC on the Trial of Cases Involving E-Commerce Platform Intellectual Property Disputes (Draft for Comment) [最高人民法院关于审理涉电子商务平台知识产权纠纷案件的指导意见(征求意见稿)].
Members of the public may send their comments on any of the above draft documents to No. 3 Civil Tribunal of the SPC by mail or e-mail by the deadline of 27 July 2020.
