CNIPA Invites Comments on Draft Criteria for Determining Trademark Infringement
On 18 December 2019, China National Intellectual Property Administration (CNIPA) published the Criteria for Determining Trademark Infringement (Draft for Comment) to invite public comments on the draft.
The draft provides further rules on the determination of trademark infringement so as to facilitate enforcement agencies to deal with trademark infringement cases. It consists of 58 articles in eight chapters, covering mainly the issues of trademark use, infringement determination, exceptional circumstances relating to infringement, suspension applicability, and conflict of rights.
Professionals and the public, if interested, may submit their comments via email, fax or letter to CNIPA by the deadline of 18 January 2020.
