Beijing IP Court Concludes Close to 60,000 Cases in First Five Years
At a press briefing on 6 November 2019, Beijing Intellectual Property Court (BIPC) released statistics relating to its adjudication work over the past approximately five years since inauguration. As reported, from 6 November 2014 to end of September this year, close to 60,000 IP cases were concluded by the court.
In terms of acceptance of cases, 70,924 IP cases were accepted by the court during the five-year period, with an average annual growth rate of 26%, and 44,924 among them were IP grant and affirmation cases, 87% of which relating to trademark and 13% to patent. By case type, 70% of the cases accepted were administrative cases and 30% civil cases, whereas by realm of IP, 58% related to trademark, 25% to copyright, 13% to patent, and the rest (4%) to unfair competition, licensing, and technology contract. For patent cases in particular, 49% of the cases accepted related to invention patent, 19% to utility model patent, and about 7% to others (such as patent agency contract dispute).
BIPC is the first specialised IP court in China, whose jurisdiction covers IP grant and affirmation administrative cases nationwide as well as IP civil and administrative cases within the Beijing municipality.
