Seminar Marking 10th Anniversary of China's Anti-Monopoly Law Held in Beijing

On 20-21 November 2017, a seminar marking the 10th anniversary of China's Anti-Monopoly Law co-organised by United Nations Conference on Trade and Development (UNCTAD) and China University of Political Science and Law (CUPL) was held in Beijing.
The seminar, titled "10th Anniversary of the AML: Trends, Challenges, and Successes", discussed the development of the national competition policies and addressed frontier issues of the Anti-Monopoly Law of China, touching upon the following aspects: merger control; fair competition and administrative monopoly; China's accomplishment in anti-monopoly legislation and enforcement; the Internet and studies of recent related cases; big data and anti-monopoly enforcement in China; "refusal to deal" and development of "essential facilities doctrine" from a global perspective; recent development of the FRAND (fair, reasonable, and non-discriminatory) principle; cartels-related cases; and the shift in basis of anti-monopoly investigation from "per se prohibitions" to evidence on impact.
The seminar was attended by 130-plus representatives from anti-monopoly authorities, associations, research institutes as well as lawyers and in-house counsel from home and abroad. The in-depth discussion and extensive exchanges about heated issues related to competition law during the session were beneficial to the betterment of the Chinese Anti-Monopoly Law in both enforcement and judicial practice.
