Shanghai IP Court Publishes 2016 Judicial IPR Protection Report
According to the White Paper on Judicial Protection of Intellectual Property Rights 2016 published by Shanghai Intellectual Property Court on 12 April 2017, the Court accepted 1,877 IP cases in year 2016, up 14.38% year-on-year, which included 904 first-instance and 973 second-instance cases.
Among the IP cases accepted by the Court during the year, apart from some licensing, technical secret, unfair competition, and monopoly cases, 559 cases related to patent, 247 to trademark, and 921 to copyright.
Notably, during the year the Court awarded heavy damages in some cases, directed especially at such malicious behaviours as repeated or intentional infringement. Among them were a trademark and unfair competition case in which the plaintiff Hugo Boss Trade Mark Management GmbH & Co.KG was awarded RMB4.92 million and a trademark infringement case in which BMW was awarded RMB3 million for compensation of economic loss.
