SIPO Seeks Public Opinions on Patent Administrative Enforcement Guidelines (Draft for Comments)
The State Intellectual Property Office of China (SIPO) has published the Guidelines on Patent Administrative Enforcement (Draft for Comments), which are now available for public comments until 10 November 2015.
The Guidelines aim at regularising administrative enforcement operation nationwide toward consistent, efficient and quality patent protection in the country. There are seven chapters in the Guidelines, namely, general provisions; disposition of patent infringement disputes; investigation and disposal of patent passing-off; mediation of patent disputes; trans-jurisdictional and inter-departmental coordination of patent administrative enforcement; disposition of patent infringement disputes in the fields of exhibition, conference, and e-commerce; and management of enforcement operation. In addition, the Guidelines also provide samples of relevant standard forms.
Members of the public, if interested, may voice their opinions or suggestions through e-mail, fax or letter to Patent Affairs Administration Department of SIPO before the deadline.
