Latest Amendments to Chinese Guidelines for Patent Examination to Take Effect on 15 January 2021
On 11 December 2020, the China National Intellectual Property Administration (CNIPA) issued Announcement No. 391 to amend the Guidelines for Patent Examination. These amendments of the Guidelines relate specifically to provisions on examination of invention applications in the field of chemistry under Chapter 10 of Part II, and make some substantial changes to examination on such issues as supplementary experimental data, assessment of inventive step of compound inventions, and definition of monoclonal antibodies.
The Amendments will come into force on 15 January 2021.
