Beijing IP Court Senior Judge Delivers Training on Patent Administrative Litigation for CPA Attorneys
On 14 July 2017, China Patent Agent (H.K.) Ltd. (CPA)'s close to 100 patent attorneys and patent engineers from its offices in Beijing, Hong Kong, Shenzhen, and Shanghai gathered to attend a training session organised by Beijing Patent Attorneys Association (BPAA) in person or via teleconference. This training session featured a three hours' lecture on judicial examination of patent grant and affirmation cases by Senior Judge Deng Zhuo from Beijing Intellectual Property Court (BIPC).
During the lecture, Judge Deng first introduced the basic types of patent grant and affirmation cases generally heard by the Chinese courts as well as BIPC's case receiving and closing status in recent years. He also provided adjudication data such as proportion of patent administrative cases being revoked and statistics on legal issues involved in those cases. After that he focused on the procedural matters to note over the course of litigation including lawsuit filing, responses to complaints, exchange of evidence, court hearings, judgment pronouncement, and appeal making. Lastly, he identified the major substantive issues found in patent grant and affirmation cases, and went over the provisions of the Chinese Patent Law that are relevant to those substantive issues. Judge Deng used many typical cases to illustrate his points and shared with us the judgment of cases from a judge's perspective. His clear and comprehensive delivery of the materials rendered the lecture well received by our colleagues.
This training session was the third of the 2017 BPAA training series for CPA professionals as part of our consistent efforts to upgrade our service quality through enhancing staff members' technical legal capability. The previous two sessions of the training series have dealt with the themes of 2017 revisions of Guidelines for Patent Examination and invention application drafting from the perspective of patent infringement respectively.
