CPA's Entrusted Infringement Case Chosen for Court Trial Observations
On 19 April 2011, an open court session for a patent infringement case represented by China Patent Agent (H.K.) Ltd. (CPA) was held in Tianjin No. 2 Intermediate People's Court. The trial was chosen for court trial observations, and had the presence of some Tianjin deputies to the National People's Congress, members of National Committee of the Chinese People's Political Consultative Conference (CPPCC), judges, and media members.
CPA attorneys Mr. Wu Yuhe and Mr. Li Rongxin represented the Swedish plaintiff, a leading enterprise in global heat exchanger sector, in the action against the accused infringer in Tianjin. CPA deputy general manager Mr. Luo Hong and assistant general manager Mr. Kong Zhiqiang also attended the hearing.
During the trial, Mr. Wu Yuhe and Mr. Li Rongxin detailed and illustrated with powerpoint relevant issues, including technological information related to the patent in suit, protection scope of the claims, infringing acts of the defendant, and damages. They also made a plea that the defendant should assume civil liabilities by stopping the infringement, destroying the infringing goods and moulds, making apology as well as compensating the plaintiff for economic loss incurred by the infringement, while refuting the defendant's non-infringement and prior art defenses.
