Operational Guidelines for SEP Licensing Co-compiled by CCPIT Released

On 25 April 2024, the Operational Guidelines for Standard Essential Patent Licensing were released during a global intellectual property (IP) protection and innovation forum held in Beijing. The Guidelines were jointly compiled by the China Council for the Promotion of International Trade (CCPIT) Commercial Legal Service Center and the Beijing Intellectual Property Public Service Center under the guidance of the Beijing Intellectual Property Office.

The Guidelines overview SEP-related laws and regulations, policies, and court cases in key jurisdictions including China, the US, Europe, Japan, Germany, and the UK, outline the development of the justice system and analyse policy trends in areas of concern relating to SEP in those jurisdictions, caution about the risks involved in SEP licensing, and give suggestions on operation of the licensing.

In recent years, the benefits of international industrial standardisation have become commonly acknowledged by the technological innovation sector. In future, the CCPIT Commercial Legal Service Center will pinpoint its direction of work on the needs of the industries, broaden the range of services, and deepen international cooperation, with prioritisation of research and services given to standard essential patents, cross-border e-commerce, and IP transformation and exploitation.
