SPC IP Court Annual Report 2023: Continued Increase in Number of Cases Accepted and Concluded
On 23 February 2023, the Intellectual Property Court (IP Court) of the Supreme People's Court of China, the national-level IP dispute appeal mechanism that started operation in January 2019, released its 2023 annual report and published summary of its adjudication tenets derived from cases concluded in 2023.
In 2023, the IP Court accepted a total of 7,776 technology-related IP and monopoly cases (5,062 new cases and 2,714 outstanding cases), an increase of 25.8% year-on-year. Among the newly accepted cases, 421 were foreign-related, accounting for 8.3% of the new cases accepted.
During the year, 4,562 newly accepted cases were concluded, a year-on-year increase of 31.5%, representing a settlement ratio of 90.1%. Of the said concluded cases, 2,260 cases were closed by maintaining the original judgment, accounting for 49.5% of the new cases concluded; 981 by withdrawing the lawsuit (21.5%); 368 by mediation (8.1%); 10 by remanding for retrial (0.2%); 892 by reversing the original judgment (19.6%); and 51 by other means (1.1%).
Concurrently with the annual report, the IP Court also published the Summary of the Adjudication Tenets of the Intellectual Property Court of the Supreme People's Court 2023. The adjudication tenets, consisting of 104 rules demonstrating the IP Court's judicial concepts, adjudication reasoning, and judgment method for the reference of the public, were derived from 96 cases among the new cases concluded in 2023.
