CPA Invited to Participate in 2023 Belt and Road International Commercial Arbitration High-Level Dialogue

The 2023 Belt and Road High-level Dialogue on International Commercial Arbitration was held in Xi'an, Shaanxi province on 7 December 2023. This dialogue, in its 6th edition, was the first one held outside of Beijing. Nearly 300 representatives from the arbitration, legal, and industrial and commercial circles attended the meeting on-site, and about 51,200 domestic and foreign viewers watched the live broadcast of the meeting online. China Patent Agent (H.K.) Ltd. (CPA) Beijing Office deputy director and Legal Affairs Department manager Mr. Wen Dapeng was invited to participate in the dialogue.

The high-level dialogue featured results release, keynote speeches, and panel discussions. Topics discussed included Belt and Road arbitration, IP and diversified dispute resolution, energy transition, and international arbitration. Among the discussions, CCPIT Patent and Trademark Office counsel Mr. Ma Hao hosted the session on "The Road to Innovation: Intellectual Property Rights and Diversified Dispute Resolution", and Mr. Wen Dapeng, deputy director of the Beijing Office of our firm, gave an introduction of the characteristics of IP mediation, and explored together with judges, business representatives, and lawyers the improvement of China's diversified IP dispute resolution mechanism.

The event also saw the release of the 2023 version of the Dispute Resolution and Legal Application Model Clauses for Enterprises' Foreign-related Transactions. The model clauses advise enterprises to give priority to resolving disputes through non-adversarial means such as negotiation and mediation, and focus on promoting the complementary application and effective link between the dispute resolution means of mediation, arbitration, and litigation.

Given IP mediation's significance in strengthening the whole-chain protection of IP and optimising business environment, CPA will actively study and engage in promoting the diversified resolution of IP disputes, and facilitate various market entities at home and abroad with more efficient, convenient and low-cost means to resolve IP disputes.
