SAMR of China Seeks Public Opinions on Anti-Monopoly Guidelines in the Field of Standard Essential Patents (Draft for Comment)

The State Administration for Market Regulation (SAMR) of China has recently published the Anti-Monopoly Guidelines in the Field of Standard Essential Patents (Draft for Comment) ("the draft Guidelines") to seek comments from the public. The draft Guidelines were written with a view to preventing and curbing business operators from abusing standard essential patents (SEP) to eliminate or restrict competition, maintaining fair market competition, promoting the coordinated development of intellectual property and standards, encouraging innovation, and protecting consumer rights and public interests. Interested entities or individuals are welcome to submit feedback on the draft Guidelines to the SAMR online (http://www.samr.gov.cn), via email (fldys@samr.gov.cn), or by mail (attention: Anti-Monopoly Law Enforcement Division I of the SAMR) on or before 29 July 2023.
